Terms of Service

1. Acceptance

By creating an account or using Fit Check (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by The Fit, LLC (“we,” “us”).

2. Eligibility

You must be at least 13 years old to use Fit Check. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. Your Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use at support@afitcheck.com.
  • One person may not maintain multiple accounts.

4. Content You Upload

You retain ownership of photos and content you upload. By uploading content, you grant The Fit, LLC a limited, non-exclusive license to store, display, and process that content solely to provide the Service to you. We do not use your personal photos to train AI models or share them with third parties except as necessary to operate the Service (e.g., sending a photo to an AI API you explicitly triggered).

You must not upload content that:

  • Violates any applicable law.
  • Infringes intellectual property rights of others.
  • Contains nudity, obscene material, or content depicting minors inappropriately.
  • Is used to harass, threaten, or harm others.

We reserve the right to remove content that violates these Terms.

5. AI Features

Fit Check uses AI (Anthropic Claude, Fashn.ai) to provide fit analysis and virtual try-on features. AI-generated outputs are provided for informational and entertainment purposes only and may not be accurate. We do not guarantee the accuracy, fitness for purpose, or completeness of AI-generated content.

6. Prohibited Use

You may not:

  • Attempt to access, tamper with, or disrupt the Service or its infrastructure.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated means (bots, scrapers) to access the Service without our written consent.
  • Use the Service for any illegal purpose.

7. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time via your profile settings; deletion is processed within 30 days.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIT, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in California.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will update the “Last updated” date above when changes are made.
